CURRENT
CONDITIONS OF USE
Editors
note:
The
conditions of use for both the inner and the outer Boiler Point reclamations
are identical apart from the sctions of the Town and Country Planning Act
that they are pursuant to, and are set out below in detail.
The
conditions set out below remain intact and have been incorporated into
the proposed district plan apart from a small change to clause 10 (below)
which is concerned with height limits. These imposed limits have since
been modified a little, but as they stand in the proposed district plan
they are 8.5 metres. Careys Bay residents have no argument with this condition.
There has also been a deviation from the vehicle access asked for in clause
14, in as much as the plan was changed. In light of the current proposal
this access will now be in dispute once again.

noise requirements requested in clause 4 are currently in dispute refer
here to learn more.
We
have ommitted 'Section A' from the conditions below as that section dealt
with the method of construction of the reclamation and as such does not
have any bearing here.
Boiler
Point Inner Reclamation
Shall
be allowed pursuant to sections 72 and 75 of the Town and Country Planning
Act 1977, subject to the following conditions:
Boiler
Point Outer Reclamation
Shall
be allowed pursuant to section 33 of the Town and Country Planning Act
1977, subject to the following conditions:
B
Following completion of construction
1
Prior
to use, the reclamation is to be sealed.
2
The
use of the area shall be restricted to the following:
-
a The
berthage of vessels on the west facing edge of the reclamation only.

b The
repair, building, maintenance and servicing of vessels.
-
c The
storage of good materials and the consolidation and distribution of those
goods and materials, except that the following goods and materials are
excluded:

i Woodchips;
-
ii
Fertilizer;
-
iii
Logs
-
d
Engineering workshops, tradesmen's yards
-
e
Road transport yards, rail sidings.
-
f
Administrative offices, staff facilities, that are ancillary to the above.
-
g
Water based recreation facilities, adjacent to water areas.

all exterior lighting shall be designed, installed and maintained so that
there is no direct light spill beyond the boundary of the site.

All
uses permitted by this consent are to meet the following noise levels:
The
corrected noise level (L10) as measureed at the boundary of any rural or
residential zone shall not exceed the following limits:
7.00am - 11.00 pm 55dBA L10
At all other times 45dBA L10 and an Lmax of 75 dBa
Noise
shall be measured in accordance with NZS 6801:1977 and Corrected Noise
Levels shall be determined in accordance with NZS 6802:1977.

Storage
of any materials or goods associated with on the site shall be so ordered
that there shall be no contamination of adjacent sites, roads and water
areas.

The
occupier of any premises is expected to adopt the best practical means
to minimise the emission of smoke, smell, and other pollutants from the
premises and to render any air pollution harmless and inoffensive.

All
uses on the site shall be established and managed so that there is no electrical
interference with television and/ or radio reception within an adjoining
residential zone.

All
uses that are required to be licenced under the Dangerous Goods Act 1974
shall be established and carried out in accordance with the licenced conditions.

All
liquid wastes shall be disposed of, either into the public sewerage reticulation
system(in which case pretreatment may be required), or in accordance with
a right issued in terms of the Water and Soil Conservation Act 1967.
10
No buildings, structures, stored goods and other materials or parts thereof
may exceed a height of 8 metres above the ground level.
11
Signs are permitted in the following circumstances:
a Signs
attached to and forming part of any building provided that they do not
exceed the height of the building.
b
Illuminated signs, attached to and forming the part of any building, providing
that:
i
They do not exceed the height of the building.
ii
they do not exceed 4 square metres total area on any site.
iii
No illuminated sign shall be flashing.
iv
No illuminated sign can be seen from any residentially zoned property within
200 metres of the sign.

Safe access for vessels between the reclamation and the fishermen's wharf
is to be retained.

All electrical wiring, cabling and other services are to be located underground.
14
Vehicle access to the site from Macandrew Road is to conform generally
with attached figure 3.
15
All uses that would give rise to vibrations shall be so managed and controlled
that no objectionable vibration is discernable beyond the boundaries of
the site and that no vibration is discernable with any Residential zone.
